1. General Information

These Terms and Conditions ("Terms") govern the use of the website and the purchase of products offered by IMPORT SRLS, a company incorporated under Italian law, with registered office at Via Enrico Consenz 16, 20158 Milano (MI), Italy, VAT number IT14604240961 ("the Company", "we", "us").

By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully before making a purchase.

2. Products and Services

We offer smart home automation products including, but not limited to: gate automation systems, garage door motors, shutter and blind motors, alarm and security systems, control systems, and related accessories. Product descriptions, specifications, and images on our website are provided for informational purposes and may be subject to minor variations.

We reserve the right to modify our product range, pricing, and specifications at any time without prior notice. Changes will not affect orders that have already been confirmed.

3. Pricing and Payment

3.1 Prices

All prices displayed on our website are in Euros (€) and include VAT (IVA) at the applicable Italian rate, unless otherwise stated. Shipping costs are calculated separately and displayed at checkout.

3.2 Payment Methods

We accept the following payment methods:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • Bank transfer (SEPA)
  • PayPal

Payment must be received in full before orders are dispatched. For bank transfers, please allow 2-3 business days for payment processing.

4. Order Process

The order process consists of the following steps:

  • Product selection and addition to cart
  • Review of cart contents and shipping details
  • Acceptance of these Terms and Conditions
  • Payment submission
  • Order confirmation email from us

A binding contract is formed when you receive our order confirmation email. We reserve the right to refuse or cancel any order due to product unavailability, pricing errors, or suspected fraudulent activity.

5. Warranty

5.1 Legal Guarantee (Consumers)

In accordance with Articles 128-135 of the Italian Consumer Code (D.Lgs. 206/2005), all products sold to consumers are covered by a legal guarantee of conformity of 24 months from the date of delivery. This guarantee covers defects of conformity that exist at the time of delivery and become apparent within two years.

5.2 Manufacturer's Warranty

Many of our products also carry a manufacturer's warranty, the terms and duration of which vary by product. Details of the manufacturer's warranty are provided with each product. The manufacturer's warranty is in addition to, and does not replace, the legal guarantee.

5.3 Warranty Exclusions

The warranty does not cover:

  • Damage caused by improper installation or use
  • Normal wear and tear
  • Damage caused by unauthorized modifications or repairs
  • Damage resulting from external factors (power surges, water damage, extreme weather)
  • Products used for purposes other than their intended use

6. Limitation of Liability

To the maximum extent permitted by applicable law, IMPORT SRLS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our products or services. Our total liability for any claim shall not exceed the amount paid by you for the specific product giving rise to the claim.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of IMPORT SRLS or its licensors and is protected by Italian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

8. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, government actions, supply chain disruptions, or carrier delays.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Italian Republic. For consumer disputes, the competent court shall be that of the consumer's place of residence or domicile, as provided by Article 66-bis of the Consumer Code.

For business-to-business transactions, any disputes shall be subject to the exclusive jurisdiction of the Court of Milan, Italy.

10. Alternative Dispute Resolution

In accordance with EU Regulation 524/2013, consumers may submit complaints through the European Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the intended economic purpose.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon publication on our website. Continued use of our website after changes constitutes acceptance of the modified Terms. Orders placed before modifications will be governed by the Terms in effect at the time of order.
